Terms of Service

1. Acceptance of Terms

By accessing or using Upstream ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Upstream provides an AI-native feature flagging and rollout intelligence platform via API and web dashboard. Features include Dynamic Config API, AI Rollout Pilot, Anomaly Guard, Codebase Intelligence, and Config Copilot.

3. Account Responsibilities

  • You are responsible for maintaining the confidentiality of your API keys.
  • You are responsible for all activity that occurs under your account.
  • You must provide accurate information when creating your account.

4. Acceptable Use

You may not use Upstream to: violate any law or regulation, infringe intellectual property rights, transmit malicious code, or interfere with the Service's infrastructure.

5. Pricing and Payment

Subscription fees are billed monthly or annually. Upstream reserves the right to modify pricing with 30 days' notice. All fees are non-refundable except as required by law.

6. SLA and Uptime

Upstream targets 99.98% platform uptime. Formal SLA commitments are available on Scale and Enterprise plans as specified in your order form.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You retain ownership of your data. Upstream processes data only as necessary to provide the Service.

8. Intellectual Property

Upstream retains all intellectual property rights in the Service. You retain rights to your configurations, flag data, and customer data.

9. Limitation of Liability

To the maximum extent permitted by law, Upstream's liability is limited to the amount paid by you in the 12 months preceding the claim.

10. Termination

Either party may terminate this agreement with 30 days' written notice. Upstream may terminate immediately for material breach.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law provisions.
